Tern Overseas helps the students and candidates to apply to their desired university for their further education or academic journey.
The current visitor of this website can be a student, a candidate, a parent or a guardian to the student, or any individual who is just a visitor or an expected client of the services offered on the website being any gender as described under the Indian Constitution, understands that you are willing to accept our services to find solutions to your concerns regarding your further educational journey.
Hereon, throughout this agreement, Tern Overseas, the proprietor firm ‘Tern Overseas website’ or employees of the firm will be termed as the ‘PROVIDER’ and any student, candidates, parents or guardians of the students, or any person desiring to accept our services, as a site visitor, a member or a paid customer of the services the Tern Overseas is offering, will be termed as ‘RECEIVER’ throughout the agreement.
These Terms set forth the terms and conditions under which any Receiver may use the Tern Overseas website. By accessing or using the website of our service, you approve that you have read, understood, accepted and agree to be bound by these Terms till the time the ‘Receiver’ uses the site and services offered by the ‘Provider’.
In order to use our website and/or receive our services, the Receiver must be at least [18] years of age, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. Receivers are not allowed to use this website and/or receive services if you are a minor and are booking our services all alone. A Receiver who is a Minor can book our services with the help of a family member/ guardian whose age is above 18 years and can avail services on the major’s name.

The Receiver of the website can explore any page that is being made visible by the Provider. The website is made for the sole purpose that the Receivers can understand the various services that are provided by the Provider and then book any of the preferred services by making a full advance payment and starting with the desired service.
BOOKING A SERVICE:
The receiver agrees to understand and accept that as this is a Study Abroad Consultancy firm the Receiver can book the services provided by the Provider for receiving the same through Online Medium Only. The receiver will understand all the terms, conditions, privacy policy, cancellation and refund policy before booking any service through the website of the provider. The receiver will make the payment for booking the service only after understanding and agreeing to all the terms, conditions, privacy policy, cancellation and refund policy without any alteration or modifications thereon. The receiver agrees to understand and accept that the services provided by the provider are just guidance and approaches. Any decision about the future, the education, the choice of course, subject its major and minor, university, country, accommodation, payment process, visa process, hereon will be taken only by the Receiver, Provider will only guide or consult but the actual decision for any process has is taken by the Receiver throughout the process. The provider or any of their staff will not be forced or is not legally bonded to give any decision thereon. By making the payment for the bookings of the services the receiver also agrees to understand and accept that they have read all the cancellation and refund policy mentioned on every service booking.
ETHICAL & LEGAL PROCESS:
As the whole process requires legal and ethical steps the receiver agrees to share any and every information, facts, documents, papers, credentials that are correct, right and clear. These documents, papers, credentials should not be Forged, Manipulated, Counterfeit, fake, bogus, Fraudulent or illegal. And if the receiver provides any such information or document that is illegal, Provider reserves the right to discontinue the service on the immediate basis. Also, Receiver agrees that the Provider isn’t aware or involved in any such unethical or illegal practices. Finally, the receiver relieves the provider from any such knowing and if there is any legal case the total responsibility of the same shall be taken by the Receiver throughout.
SERVICES:
1) Study Abroad Application: With this service, Tern Overseas is just taking a refundable deposit of INR 10,000 to start with. This deposit will be refunded only if the receiver fulfils the following conditions:
- The whole End-to-End Study Abroad Application Process has to be done through Tern Overseas.
- The receiver follows each and every step guided by the Provider through the process
- The receiver secures admit in the university, college or institution guided by Tern Overseas in its initial partner university list.
- There is no change in the consultant/ agent from the receiver’s side throughout the process.
- That the student has cleared all pending payments for Tern Overseas Processes that they have availed till date.
- And, the student completes at least 4 months of course in that Partner University selected by the receiver from the initial partner university list.
Once the receiver has fulfilled the above-mentioned conditions the refund shall be initiated. If the student doesn’t fulfil any of the terms the deposit for this service isn’t refundable. The service once availed is also not cancellable or transferable.
2) Top University Application: This service is specifically for students targeting IVY leagues, Russell Group, Go8 and LERU universities, colleges or institutions. This service is just for applying to Top Universities globally. No other service mentioned in the additional service is clubbed with this service. This service has a 1-time fees and the whole fees have to be paid upfront in advance. The charges for this service vary from INR 40,000 to INR 2,00,000 each university, college or institution selection as the inclusion of time and effort for each university differ and once the receiver confirms their preferred university, college or institution the specific charges will be guided to the receiver. Once the fee is received by the Provider the service shall initiate. This fee shall be Non-refundable in any circumstance so it is advised to be sure before availing the service. This service is also non transferable to any other receiver at any point of the service. The fees for this services isn’t refundable or cancellable or transferable.
3) Additional Services: There are variety of services that we offer in this section (Student Accommodation, Education Loan, International Remittance, Fees Payment & Fund Transfer, student insurance, Student Visa, Booking International Student Flights, Foreign Currency Exchange & Forex Cards). The receiver is expected to understand from the providers the inclusions, limitations and support of each service before availing any of these services. The receiver has to make the advance payment of any or each of the service the receiver plans to avail. The fees for any of these services isn’t refundable or cancellable or transferable.
4) Entrances & Languages Services: There are variety of Entrances & Languages services that we offer in this section (TOEFL, IELTS, GMAT, GRE, SAT & PTE and Languages training like German, French & Japanese). The receiver is expected to understand from the providers the inclusions, limitations and support of each service before availing any of these services. The receiver shall be offered a live Demo before initiating any of these services. The receiver is expected to avail any of or combination of these services only when they have liked and understood the way in which these are offered by the tutor in the Demo. The receiver has to make the advance payment of each or any combination of the service the receiver plans to avail. The fees for any of these services isn’t refundable or cancellable or transferable.
RIGHT TO SUSPEND OR CANCEL USER ACCOUNT
The Provider may permanently or temporarily terminate or suspend Receivers access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable laws of the Nation or regulations. The Receiver may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which the receiver has already made payment for.
INDEMNIFICATION:
The Receiver agree to indemnify and hold the Provider, [Tern Overseas, its team, its freelance consultants and every person directly or indirectly associated with Tern Overseas] harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to inappropriate education and/or career and or educational choice or in connection with your use of the website or any of the services offered on the website.
LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, in no event shall [Tern Overseas] the Provider, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.
To the maximum extent permitted by applicable law, [Tern Overseas] the Provider assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of services provided by the Provider; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
Provider is just the mediator and that we don’t have any control over any 3rd party services (Course at a University, Stay at any accommodation, Education Loan from any bank or NBFC, Fund Transfer, remittance, university fees payment, forex cards or foreign exchange availed through any vendor, Student insurance from any Insurance providers, Student Visa facility from any country specific embassy, Student flights from any airlines, Entrance or Language training by any tutor) you plan to occupy or avail through our list of contractors, associates, partners or ventures. The Receiver shall not blame or claim for any loss, damage, delay, failure from Tern Overseas. Provider shall mediate but will not be responsible for any loss in any way and would not be refunding the claim on behalf of any 3rd parties incompetencies to fulfil their services.
Receiver understands, agrees and accepts that the Provider cannot guarantee any result, certain outcomes, achievements, outputs through out the process and that provider is just processing the services for the receiver.
RIGHT TO CHANGE AND MODIFY TERMS
The Provider reserves the right to modify these terms from time to time at their sole discretion. Therefore, The Receiver should review this page periodically. When the Terms are changed in a material manner, we will notify the active Receiver that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of the terms or any future version of the Terms, we instruct you to not use or access (or continue to access) the website or the services provided by the Provider.
PROMOTIONS:
The Receiver agrees to receive from time-to-time promotional calls, messages and materials from The Provider, by mail, email or any other contact form you may provide us with (including your phone number for calls, what’s app or text messages). If you don’t want to receive such promotional materials or notices – please just notify us at any time and we may try removing your details from that promotional list.
